Sovereignty of the Soul: Exploring the Intersection of Rape Law Reform and Federal Indian Law  Δ

This article is about tribal issues and sexual assault, and it is directed not so much at beyond prosecution as it is beyond jurisdiction. It focuses on an invisible legal challenge in addressing sexual violence. The focus is not on the federal or state system, but rather the third sovereign in this nation, the tribal justice system. There are over 550 federally-recognized tribal governments in the United States, each with a separate and distinct judicial system. Tribal justice systems can have a tremendous impact on the survivors of sexual violence, particularly Native American survivors who reside in tribal communities. The author, Sarah Deer, is currently the Victim Advocacy Legal Specialist with the Tribal Law & Policy Institute. She is also an online Instructor of Tribal Legal Studies at UCLA Extension and former Lecturer in Law at UCLA Law School. Sarah is a co-author of two textbooks published by Alta Mira Press: Introduction to Tribal Legal Studies and Tribal Criminal Law and Procedure and co-editor of the forthcoming book, Sharing our Stories of Survival: Native Women Surviving Violence.

Return to the Circle: Considering Vision and Values in Our Leadership Δ

This article opens up the notion that we have the responsibility to carry forward the spirit of our ancestors in our work. It is not enough to be a program on Tribal lands, operated by the Tribe or designed by Native people. We have a responsibility to recognize the history of assimilation and oppression that each of us caries while working to enhance our leadership from within our own Tribal values, working to avoid replicating mainstream models of leadership.The author, Vicki Ybanez, is currently the Executive Director of Red Wind Consulting, a tribal technical assistance provider. She also works as a technical assistance partner with Mending the Sacred Hoop, Inc., Praxis International and the Battered Women's Justice Project. She has authored several articles focused on domestic violence issues and has been published in three anthologies.
